It's a sad situation but every time someone's tried to resolve it they've failed miserably.
And in the grand scheme of things it's not a big deal. Most of us can still get along.

I'm getting the suspicion that the problem is that the code is rather hard to work with... otherwise you might as well just do it properly. Everyone knows how an observer mode is supposed to work - it's not rocket science and we don't need to rethink it.

The Rebirth code has very few modifications of the original code. In other words: Changing something in Rebirth means you still have to wade through tons of spaghetti code and change the code at a dozen or more different locations to make an observer mode work. This means you need to know the code very well. That is something that probably does not apply to many Rebirth devs.
